“शादी तो हुई ही नहीं थी… फिर 498A कैसे लग सकता है?”
यह सवाल अब सिर्फ किसी chai-table discussion का हिस्सा नहीं रहा. Supreme Court ने 3 August 2026 को एक ऐसा judgment दिया है जिसने live-in relationships और Section 498A के बीच का legal conversation बदल दिया है.
In Lokesh B.H. v. State of Karnataka, the Supreme Court considered whether a man in a live-in relationship could face prosecution under Section 498A IPC. The Court held that 498A can extend to a live-in relationship when it qualifies as a relationship in the nature of marriage and the intention to marry is an intrinsic part of that relationship.
लेकिन यहाँ एक important “लेकिन” है.
इसका मतलब यह नहीं है कि हर live-in relationship automatically 498A बन गया.
The Supreme Court specifically limited this interpretation to Section 498A and emphasised that the factual ingredients of cruelty still have to be satisfied. The Court also reiterated the safeguards governing arrest; the existence of a complaint does not mean that arrest should simply happen mechanically.
अब सोचिए उस आदमी की situation, जो कई साल से किसी woman के साथ रह रहा था, दोनों families उसे husband-wife की तरह जानते थे, और relationship टूटने के बाद अचानक criminal complaint सामने आ जाती है.
वह शायद सबसे पहले Google पर लिखेगा — “where can husband complain against wife?”

लेकिन live-in matter में पहला सवाल ही अलग हो सकता है: “हमारे relationship की actual nature क्या थी?”
क्या दोनों साथ रहते थे? क्या relationship को social level पर marriage जैसा represent किया गया था? क्या marriage की intention थी? क्या alleged cruelty के specific facts हैं? और complaint में exactly क्या allegations हैं?
यानी सिर्फ “हम married नहीं थे” बोल देना भी पूरी legal story नहीं है.
और दूसरी तरफ, सिर्फ “हम husband-wife जैसे रहते थे” कह देने से भी हर allegation automatically proved नहीं हो जाता.

क्योंकि relationship चाहे traditional marriage हो या complicated live-in arrangement, breakup के बाद emotions बहुत तेज होते हैं. कल तक जो “हम दोनों” था, आज वही “उसने मेरे साथ…” बन जाता है.
और वहीं से screenshots, complaints और counter-complaints शुरू हो जाती हैं.
