DELHI HIGH COURT: CAN AN ALLEGATION ABOUT THE WIFE'S RELATIONSHIP STOP INTERIM MAINTENANCE?

A husband was facing a matrimonial dispute.

He had his own financial pressures: a home-loan EMI, insurance expenses, school fees and responsibilities towards his elderly parents.

But another issue became central to the dispute.

He alleged that his wife was, or had earlier been, in an illicit relationship.

Could that allegation by itself stop her interim maintenance?

THE DELHI HIGH COURT JUDGMENT

In CRL.M.C. 5097/2024, decided on 4 April 2026, the Delhi High Court examined this issue while considering interim maintenance proceedings under the Domestic Violence Act.

The Court's important point was that allegations about the wife's alleged relationship could be relevant to the overall case, but bald and unsubstantiated allegations could not, at the interim stage, by themselves justify denying maintenance.

The Court noted that whether such allegations were ultimately established was a matter requiring adjudication after evidence was led.

In other words:

An allegation is not automatically evidence.

And an interim-maintenance proceeding is not the stage for conducting a mini-trial on every disputed allegation.

BUT THE HUSBAND'S FINANCIAL LIABILITIES ALSO MATTERED

The husband placed before the Court several expenses, including approximately:

- ₹40,000 monthly home-loan instalment
- ₹20,000 health-insurance premium
- LIC premiums
- ₹11,000 school fees
- household expenses
- expenses relating to his elderly parents
- contribution towards the younger child's expenses

The judgment therefore illustrates another important point:

Maintenance litigation can involve competing financial claims that have to be examined on the material placed before the Court.

THE PRACTICAL LESSON

Separate:

what was alleged,

what documents exist,

what can actually be proved,

and what the Court is being asked to decide at the interim stage.

That distinction can become extremely important.

In matrimonial litigation, an allegation and a proved fact are not necessarily the same thing.

Before reacting to a serious allegation, identify the evidence, the proceeding and the exact question the Court is deciding.
